Timing Your Social Security Disability Claim in Ohio

What is SSD?

Social Security Disability Insurance, or SSD, provides benefits to disabled workers who have paid into Social Security through FICA taxes in the past. You may be eligible for SSD benefits if you prove you meet the statutory definition of disability.

SSD is not the same as workers’ compensation. Workers’ compensation is meant to provide financial support to workers who are temporarily disabled or unable to work for a short period of time. SSD, on the other hand, is set up to help those who will not be able to work for at least twelve months consecutive because of their disability. Further, SSD benefits may be payable for disabilities which may not have occurred in the workplace.

What is SSI?

Supplemental Security Income, or SSI, is another form of payment you can get if you’re found disabled, but the difference is in how your benefits are calculated. The disability requirements are the same for both, but SSD is paid based on your earnings history. SSI, on the other hand, is for people who either have insufficient earnings history, or people who fall below a certain income level.

Who Can Get Social Security Disability Insurance?

The general rule for Social Security Disability Eligibility is that you have been unable to work at any job for at least 6 months, and you anticipate being off work for at least 12 consecutive months. Social Security does not pay benefits until the sixth full month of disability, so individuals who are not going to be off work longer than that will not get paid, even if they are disabled. What If My Claim is Denied?

First and foremost, the Social Security Administration maintains strict timelines for filing appeals. Typically, you have 60 days from the date of receipt of your unfavorable order in which to appeal. Unfortunately, only about thirty percent of SSD claims are approved on their first time through the system. Your claim could be denied for any number of reasons. The Social Security Administration typically sends a form letter that acknowledges that you have some problems, but that they are not severe enough to meet their requirements.
